Terms of Service
1. Acceptance of Terms
By accessing or using Green Card Jobs (the "Service"), you agree to be bound by these Terms of Service ("Terms"). You must be at least 18 years of age to use the Service. If you do not agree to these Terms or do not meet the eligibility requirements, do not access or use the Service.
By creating an account or completing a purchase, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference. Your acceptance of these Terms constitutes a binding legal agreement.
2. Description of Service
Green Card Jobs provides a platform to search and sort publicly available job listings from government data files, such as those from the U.S. Department of Labor (DOL), focusing on U.S. jobs with green card sponsorship. We are not affiliated with, endorsed by, or in any way officially connected with the DOL or any other government agency. The Service is provided "AS IS" and "AS AVAILABLE" without any guarantee of perpetual availability, accuracy, completeness, or continuity.
3. Eligibility & User Responsibilities
You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. You agree to:
- Provide accurate, current, and complete information during signup and keep it up to date.
- Use the Service for lawful purposes only, in compliance with all applicable laws and regulations.
- Not reproduce, scrape, harvest, distribute, sell, or modify job data or any content from the platform in a way that violates DOL guidelines, applicable law, or these Terms.
- Not use automated tools, scripts, bots, crawlers, or any other means to access or extract data from the Service without our express written consent.
- Not attempt to hack, disrupt, overload, reverse-engineer, or misuse the Service or its data.
- Not create multiple accounts or use multiple email addresses to circumvent the 7-day free trial limitation or any other restriction.
- Maintain the confidentiality of your account credentials and notify us promptly of any unauthorized use.
You are solely responsible for all activity that occurs under your account.
4. Intellectual Property
All content, features, design, code, trademarks, logos, and other materials comprising the Service (excluding publicly available government data) are the exclusive property of Green Card Jobs and its licensors, protected by applicable U.S. and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial job search purposes, subject to your compliance with these Terms. This license does not include the right to resell, sublicense, reproduce, distribute, publicly display, or create derivative works from any part of the Service.
Job listings are sourced from publicly available government data. Your use of such data through our platform does not grant you any additional rights to that data beyond those permitted by the relevant government source.
5. Subscription, Free Trial & Payment
Upon signup, every user receives a 7-day free trial with full access to the platform. No credit card is required to start the trial. The trial allows you to evaluate the Service before deciding to purchase a paid subscription.
After the 7-day free trial expires, access to full features is restricted. Continued full access requires purchasing either a monthly subscription or a lifetime subscription.
- Pricing: Monthly subscription is $9.99 (one month of access). Lifetime subscription is a one-time payment of $49.99.
- Lifetime Subscription Definition: The "Lifetime" subscription provides access to the Service until January 1, 2199. This far-future date is used due to technical and system limitations and is intended to represent lifetime access for the practical lifespan of the Service. Access is not guaranteed beyond January 1, 2199. Earlier termination may occur only as expressly provided in these Terms (e.g., for material violation of these Terms by the user). In the event of a business acquisition, merger, or sale, the acquiring entity will be required to honor active lifetime subscriptions or provide a pro-rated credit at our then-current monthly rate for the reasonable expected remaining term, at our discretion.
- No Auto-Renewal: Neither plan auto-renews. Monthly subscribers must repurchase to continue access after each month. Lifetime access continues until January 1, 2199 (or earlier termination under these Terms). You will not be charged without your explicit action.
- Payment Authorization: You authorize the stated one-time charge ($9.99 or $49.99) via your selected payment method. By subscribing you confirm you have reviewed and accept these Terms.
- Trial Abuse: Creating multiple accounts or using different email addresses to repeatedly access the 7-day free trial is strictly prohibited. We reserve the right to detect such behavior (including via IP address, device fingerprinting, or other technical means, as further described in our Privacy Policy) and immediately terminate or restrict access to all associated accounts without refund or notice. See Section 6 regarding our refund policy upon termination for cause.
6. Return and Refund Policy
We offer a 7-day free trial specifically so you can evaluate the Service before making any purchase. Because of this trial period and the immediate delivery of digital access upon payment, all sales are generally final. We do not offer refunds except as expressly set forth in this Section or as required by applicable law.
No refunds will be issued for:
- Change of mind after access is granted or the free trial has been used.
- Dissatisfaction with the number of job listings, search results, or perceived value, provided the Service functioned as described.
- Changes in data availability — including if the U.S. Department of Labor (or any other source) ceases providing data, alters formats, or restricts access — provided we make commercially reasonable efforts to maintain service continuity or provide reasonable notice.
- Account termination resulting from your material violation of these Terms, including trial abuse.
Exceptions — when we will issue a refund or credit:
- Duplicate or erroneous charges: If you are charged more than once for the same subscription period due to a billing error, we will refund the duplicate charge. Contact us using the information in Section 15.
- Service termination by us without cause: If we permanently discontinue the Service or terminate your account without cause (i.e., not due to your violation of these Terms), monthly subscribers will receive a pro-rated refund for any unused days in their current paid period, and lifetime subscribers will receive a pro-rated credit or refund based on the equivalent monthly rate ($9.99/month) for the reasonable remaining expected access period, at our discretion.
- Applicable law: Where refunds are required by California law or other applicable consumer protection regulations, we will comply with those requirements.
To request a refund or report a billing error, contact us using the information provided in Section 15 within 30 days of the charge.
7. Data Source & Disclaimer of Warranties
Job listings are sourced exclusively from publicly available government data (primarily the U.S. Department of Labor — https://www.dol.gov). We display this data without material modification. We do not guarantee the accuracy, timeliness, completeness, continued availability, or usefulness of the data. If the DOL or other sources stop publishing, change, restrict, or remove relevant data, we will make commercially reasonable efforts to notify users and maintain service continuity, but are not obligated to obtain alternative data sources or provide refunds or credits except as set forth in Section 6.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY JOB LISTING OR DATA AVAILABLE THROUGH THE SERVICE.
Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GREEN CARD JOBS, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF EMPLOYMENT OPPORTUNITIES, BUSINESS INTERRUPTION, LOSS OF REVENUE, OR RELIANCE ON JOB LISTINGS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).
Some jurisdictions do not allow certain liability exclusions or caps. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Green Card Jobs and its owners, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit, post, or transmit through the Service.
10. Termination
We may suspend or terminate your access at any time, with or without prior notice, for material violation of these Terms — including creating multiple accounts to abuse the free trial, suspected fraudulent activity, or misuse of the platform.
We may also terminate or suspend the Service entirely, or any user's access without cause, with at least 14 days' advance written notice sent to your registered email address where practicable. In the event of termination without cause:
- Monthly subscribers will receive a pro-rated refund for any unused days in their current paid period.
- Lifetime subscribers terminated without cause will receive a pro-rated credit or refund as described in Section 6.
Upon termination for cause (your material violation of these Terms), no refund will be issued. You may also terminate your account at any time by contacting us using the information provided in Section 15. Sections 4, 7, 8, 9, 11, 12, 13, and 14 of these Terms survive any termination.
11. Referral and Affiliate Program
Green Card Jobs offers a referral/affiliate program that allows users to earn commissions and milestone bonuses by referring new customers. By participating in the Referral Program, you expressly agree to the terms outlined in this Section.
11.1 Program Terms and Eligibility
- Participation in the Referral Program is voluntary and available only to users with an active account in good standing.
- Referrals must be made using your unique referral link provided by us. Referrals made outside this system will not qualify.
- You may not refer yourself, create fake accounts, or use any fraudulent means to generate referrals.
- Participation in the Referral Program does not create an employment, agency, partnership, or joint venture relationship between you and Green Card Jobs.
11.2 Commissions and Payouts
- Commission rates, milestone bonuses, and payout thresholds are set by us. Current rates (20% commission and $10 milestone bonus per 100 referrals) are for reference only. We reserve the right to modify these rates prospectively with at least 7 days' advance notice posted in your account dashboard or sent to your registered email. Rate changes will not apply retroactively to referrals already made under the prior rate.
- All commissions are tracked in our system but remain pending until the referred user completes a qualifying purchase and any applicable cooling-off or fraud review period has passed.
- Payouts are issued via PayPal or such other payment method as we may offer, with reasonable notice of any change in available payout methods. We will make good-faith efforts to ensure at least one payment method accessible to eligible participants is available.
- Payouts are processed after manual review and approval. We reserve the right to conduct fraud review, but we will not unreasonably delay payment of legitimately earned commissions.
- Minimum payout threshold is $20.00. Amounts below this threshold will roll over until the threshold is met.
11.3 Our Rights Regarding the Program
- We reserve the right to modify, suspend, or terminate the Referral Program at any time. For material changes that affect commission rates or eligibility, we will provide at least 7 days' advance notice. For program termination, commissions earned and pending prior to termination will be paid out in accordance with these Terms.
- We may disqualify any user from the program and withhold or forfeit commissions if we have a reasonable, good-faith basis to believe the referral activity involves fraud, bots, self-referral, incentivized referrals, or any other material violation of these Terms. We will provide notice of disqualification and a brief explanation where reasonably practicable.
- Disputes regarding specific payout decisions must be submitted in writing using the contact information in Section 15 within 30 days of the disputed decision. We will review and respond within 14 business days. Nothing in these Terms limits any rights you may have under applicable law.
11.4 Prohibited Activities
- Using automated systems, bots, scripts, or any artificial means to generate referrals.
- Spamming, misleading advertising, or making false claims about our Service.
- Creating multiple accounts to exploit the program.
- Paying or incentivizing others to sign up under your referral link.
11.5 Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any loss of anticipated commissions attributable to changes to the Referral Program made in accordance with these Terms, or for delays in payouts caused by circumstances outside our reasonable control. Participation is voluntary and at your own risk.
12. Dispute Resolution & Governing Law
12.1 Informal Resolution
Before initiating any legal proceeding, you agree to first contact us using the information provided in Section 15 and describe your dispute in reasonable detail. We will make good-faith efforts to resolve the dispute informally within 30 days of receiving your notice. This informal resolution requirement does not apply where a party seeks emergency injunctive relief.
12.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including questions of arbitrability) shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except as provided in Section 12.3. The arbitration will be conducted in California (or via video/telephonic hearing if you prefer). The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 Exceptions to Arbitration
Either party may bring an individual claim in small claims court if it qualifies. Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
12.4 Class Action Waiver
YOU AND GREEN CARD JOBS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable with respect to a particular claim or request for relief, then that claim or request shall be severed and proceed in court, while remaining claims proceed in arbitration.
12.5 Opt-Out Right
You have the right to opt out of binding arbitration and the class action waiver by sending written notice using the contact information in Section 15 within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out. If you opt out, disputes will be governed by Section 12.6 below.
12.6 Governing Law & Venue
These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict of law principles. If arbitration does not apply (including after a valid opt-out), disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
13. Changes to Terms
We may modify these Terms at any time. For material changes — including changes to pricing, refund policy, arbitration, or subscription terms — we will provide at least 14 days' advance notice via email to your registered address and/or a prominent notice within the Service. The effective date of the updated Terms will be clearly displayed at the top of this page.
For non-material changes (such as typographical corrections or clarifications that do not affect your rights), changes take effect upon posting. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may request account deletion by contacting us using the information in Section 15.
14. General Provisions
14.1 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.
14.2 Force Majeure
We will not be liable for any delay or failure to perform our obligations under these Terms resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, cyberattacks, disruption of third-party data sources (including the DOL), power failures, or internet disruptions. We will make commercially reasonable efforts to provide advance notice and to resume service as soon as practicable.
14.3 Entire Agreement
These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Green Card Jobs regarding the Service and supersede all prior agreements and understandings.
14.4 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Green Card Jobs.
14.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms (including in connection with a merger, acquisition, or sale of assets), provided that the assignee agrees to honor the obligations owed to existing paid subscribers as set forth in these Terms.
14.6 California Consumer Privacy Act (CCPA)
If you are a California resident, you may have additional rights under the California Consumer Privacy Act regarding the personal information we collect. Please review our Privacy Policy for a full description of our data practices and your rights, including your right to know, right to delete, right to opt-out of sale, and right to non-discrimination.
